Disability Retirement Benefits

Disability retirement benefits are available to federal employees who have become disabled for a wide variety of reasons, including severe physical or mental illness or injury, and cannot be reasonably accommodated. To be eligible for disability retirement benefits, the Office of Personnel Management (OPM) requires that a federal employee:

  • Complete at least 18 months of Federal civilian service
  • Be disabled, because of disease or injury, for useful and efficient service in your current position, and have a doctor certify that the disability is expected to last at least one year.
  • Have certification from your federal agency that it is unable to reasonably accommodate your disabling medical condition in your present position and that it has considered you for any vacant position in the same agency at the same grade or pay level, within the same commuting area, for which you are qualified for reassignment.

At the Federal Practice Group, our attorneys can help assist you in determining whether disability retirement is an option that makes sense for you, assess your likelihood of qualifying for disability retirement benefits, and assist you in preparing the application for disability retirement, including the Standard Form 2801, Application for Immediate Retirement (CSRS) and / or the Standard Form 3107, Application for Immediate Retirement (FERS), and Standard Form 3112, Documentation In Support of Disability Retirement. Our attorneys can also assist you with filing a Request for Reconsideration with OPM in the case you receive an adverse Initial Decision denying your applications for disability retirement; and with filing an appeal of any OPM Final Decision denying benefits to the U.S. Merit System Protection Board (MSPB).
